General terms and conditions of sale of Agence Saulire

GENERAL RENTAL CONDITIONS

All rented flats are owned by private individuals. Seasonal rental on behalf of these owners is entrusted to Agence Saulire, which acts as the agent responsible for payment.

Insurance

 

All objects or personal effects belonging to the tenant are the tenant's own responsibility. They are not covered by any insurance policy issued by the building, the landlord or the agency.

The Tenant shall be required to take out insurance with an insurance company against the risks of theft, fire, glass breakage and water damage, and more generally for the totality of its rental risks both in respect of the Tenant and the Tenant's property; of its rental risks both for the rented furniture and for recourse from neighbours and third parties ; it must be able to justify this at the first request of the owner and/or its agent.

 

Cancellation insurance

 

When booking online at agencesaulire.com or by telephone, Agence Saulire systematically offers the option of taking out a cancellation insurance policy with its partner Gritchen Affinity, a registered insurance broker; Gritchen Affinity, an insurance broker registered with ORIAS under no. 110 613 17, whose registered office is located at 27 rue Charles Durand, CS 70139, 18021 BOURGES cedex, will be the sole point of contact in the event of a cancellation.

This insurance is available for all rentals of our flats, it only covers the accommodation, it does not cover any ancillary services.

This insurance applies to the cancellation or interruption of a holiday. The cost of the insurance is 4% of the public rental price (inclusive of tax).

Reservation

 

The reservation is considered by Agence Saulire to be firm and final after receipt of the deposit of 30% of the rental price and dispatch of the rental confirmation by the Agency.

 

This sum is automatically forfeited to the owner and his agent in the event of cancellation.

Rentals are generally for a minimum of 7 nights and start at 5pm on the day of arrival and 10am on the day of departure.

 

Extra nights beyond those specified in the contract will be invoiced in addition on a pro rata basis to the public rate for the corresponding week.

 

Once the reservation has been made, there can be no change of flat without incurring the total loss of the daily rate.

Departures during the course of the stay cannot give rise to any refund.
The amount of the hire and services, whether included or not, will be retained. Bank transfer charges are payable by the customer.

 

By validating his reservation the tenant, acting for himself or on behalf of the other occupants, expressly acknowledges that he has first read these General Terms and Conditions of Sale, available in the Agency, which can be downloaded or printed from https://www.agencesaulire.com/  as well as descriptions of the services they have ordered.

 

No right of withdrawal

 

The legal provisions relating to distance selling set out in the Consumer Code state that the right to negotiate does not apply to tourist services (Article L121-20-4 of the Consumer Code). Therefore, for all reservations and orders for services, the Hirer does not benefit from the right of withdrawal.

 

The Balance

 

  • The balance of the rental must be paid 1 month before the arrival date, without any reminder from Agence Saulire.
  • Any booking made less than one month before the arrival date must be confirmed in full.

 

In the event of non-payment within these deadlines, Agence Saulire reserves the right to dispose of the flat reserved, while retaining the full amount of the deposit paid at the time of registration.

 

If the Hirer is forced to cancel his rental, he must notify the Saulire Agency by écrit. The Tenant is obliged to pay the rental as follows:

 

Cancellation fees

 

From the date of reservation 45 days before arrival: 30% of the total rental amount (i.e. deposit acquired)
. 45 days before arrival = 50%
- 30 days before arrival = 50 29 days before arrival = 75%
- 20 days before arrival = 75 19 à 4 days = 90%
3 days before arrival = 100%
0 days before arrival = 100%

The deposit will not be refunded and charges will be due according to the date of cancellation.

 

guarantee deposit

 

You will be asked to pay a deposit (between €300 and €1,500 depending on the flat rented), to cover any damage that may be caused to the rented property and to furnishings or other items in the rented premises, as well as any damage to the communal areas of the residence.

 

The deposit must be paid on delivery of the keys, credit card or on our website in your customer area (payment in cash or cheque not accepted). It will be returned no later than 10 days after your departure (card prints are cancelled).

End of day cleaning is not included, if the cleaning of the départ has not been carried out by the hirer, it will be invoiced according to a fixed price and deducted from the dét;The cost of replacing all missing or damaged items in the flat, common areas and ancillary services (bed linen, towels, etc.) will also be invoiced.…).

 

If these expenses exceed the amount of the deposit, the Tenant undertakes to pay, within 8 days of receipt of proof of the expenses incurred, the additional amount

 

Applicable fees

 

Bedrooms : studio 51€ - 2 pièces 62€ - 3 pièces 77€ - 3 pièces mezzanine and 4 pièces 92€ - 5 pièces and more 120€.

Unreturned keys: 50€ + price of the key (between 10€ and 150€ per key) + 8€ key ring.

Sending back forgotten items: 15€ + actual cost of the parcel and postage.

Cleaning of bedding : cover 25€ + laundry and/or cleaning costs.


Duration

 

The duration of the sée is specified in the particular conditions of the present rental agreement. The Tenant acknowledges that the rented premises are made available to it only as a temporary residence for a period which may not be extended without the prior agreement of the Landlord;alable of the owner and / or the Saulire Agency, and that under no circumstances may he exercise a profession there, major conditions without which the present tenancy would not have been agreed.

 

The rental fee does not include:

  • Secondary tax (rate per day and per person depending on the property) and the end-of-day ménage.
  • All ancillary services: airport transfers, ski equipment, ski passes and more.

 

Welcome and handover of keys

 

The keys are handed over by Agence Saulire between 5pm and 7pm, after payment of the balance, the day tax and the guarantee deposit.

 

In the event of a late arrival, the Tenant must imperatively contact Agence Saulire during opening hours and before 6pm on the day of arrival;Failure to do so will result in the renter being unable to take possession of the rented premises until the following day without being able to claim any compensation or indemnity. The keys may only be returned to our secure key box if the balance, the day's tax and the guarantee deposit have been paid.

 

He must pay the balance of the rental price and the guarantee deposit before his arrival.

 

In the event of late possession of the accommodation and early departure, no refund may be made by the lessee.

 

The balance will also be refunded in the event of absence by failure to hand in the keys on the date specified.

 

inventory of fixtures and fittings

 

Due to the large number of arrivals and departures at the same time, the inventory and état des lieux, d’entrée et de sortie, seront effectués unilatéralement par l’Agence Saulire avant’l'arrivée et aprèsès le départ du locataire.

 

A detailed inventory can be found in each property and an inventory sheet will be given to you on arrival.

 

Since the said inventory of fixtures has not been carried out in a contradictory manner, the lessee will be granted;a period of 48 hours following the handover of the keys, to make any complaint regarding the state of the premises.

 

Passing this time limit, the Tenant will be deemed to have tacitly acknowledged the accuracy of the inventory, the condition of the premises and the equipment, that the property is clean, that it is in good repair, and that it is in good repair;riel, et de la propreté du logement, que les biens loués sont exempt de dommage lors de son entr&eute;e dans les lieux, conformément à article 1731 du Code Civil et suivants.

 

No claim concerning the inventory and the swimming pool will be taken into account after this date.

 

The lessee undertakes to allow the Saulire agency to carry out any necessary repairs to the accommodation without paying any compensation.Balconies and terraces are not snowed in.
 

 

Part - return of the keys

 

2 or 3 sets of keys have been given to the hirer. They must return them on the day of departure, MUST do so before 10am, otherwise the duplication of keys will be deducted from their deposit, as well as the parking beep for non-return if there was one.


If the tenant does not respect the check-out time an additional pro-rata day will be charged.


The flat must be left clean and tidy, dishes done and put away, vacuum cleaner emptied and cleaned, dustbins emptied, blankets folded and put away with pillows in cupboards, floors cleaned, WC and bathroom clean.

 

Occupancy

 

The Tenant undertakes’to :

 

  • Respect the dates and times of occupation of the flat, mentioned above.
  • Occupy the rented premises bourgeoisementally and reasonably.
  • Respect the internal rules of the building, in particular the obligation to be quiet after 10 pm.
  • Occupy the flat in a manner that à does nothing that may harm the neighbourhood. In particular, it must not create any noise or other nuisance.
  • AND UNDER NO CIRCUMSTANCES may he/she exceed the number of occupants as stated in the contract (in the maximum capacity of the technical data sheet), including children and pets;bés included, even if the total number of berths is greater (some flats give a choice of use between several sleeping configurations).
  • Not to make any change in the arrangement of the furniture and objects furnishing the rented property; and à refrain from transporting them out of these premises.
  • Return the premises in the condition in which the Tenant found them, cleaning is not included in the price, it may be requested in addition.
  • Pay the price of washing or cleaning any carpets, blankets, mattresses, bedding, etc., that may have been stained or damaged
  • Notify Agence Saulire of any minor maintenance work it may have carried out.
  • To allow any work to be carried out that is clearly urgent. If the work to be carried out is due to deterioration attributable to the tenant, the tenant will be billed for it.
  • No smoking in the accommodation, all flats are non-smoking.For reasons of hygiene and safety, smoking is not permitted in the flats managed by Agence Saulire.In the event of the smell of smoke or other odours being noticed, and/or

    smell marks on the furniture, Agence Saulire will deduct from the tenant's guarantee deposit the amount due corresponding to the damage suffered and the cleaning (bedding, carpets, curtains, etc.) that will be necessary.

  • Respect the laws in force, when using an internet connection, included in the reservation or rented in addition, particularly with regard to data protection, intellectual property and the appropriate use of networks.
    The agency accepts no responsibility for any misuse or abuse of the Internet connection.

 

The Tenant shall be responsible for the destruction or deterioration of any object placed at its disposal, as an accessory to the building, and for any damage that may be caused to the building and to the installations whatsoever;building and to the installations whatever they may be, as a result of abnormal use, in particular of electrical and heating appliances or obstruction of the WC, washbasin, bath or sink by objects of a nature to block the drains. In the event of suspected deterioration, the representative of Agence Saulire will have access to the rented property to carry out any necessary observations.

 

L’Agence Saulire reserves the right to visit and to show the rented premises during the rental period and, in particular, in the event of the premises being put up for sale (with an appointment being made in advance), the Tenant will not be able to object to any future visits by L’Agence Saulire

 

As a general rule, pets are not allowed.

 

No reduction in rent or compensation may be claimed by the Tenant in the event of disruption to the operation of community or public facilities.

 

L’Agence Saulute disclaims all liability for deprivations and reductions in enjoyment, not arising from its fault.

 

COVID conditions

 

Full refund of the deposit or balance, excluding administration fees which remain the responsibility of the hirer, for cancellations for at least one of the following reasons (effective on the day of):

 

  • The closure of the ski area and the ski lifts of the resort, by decree issued by the competent administrative authority, for any reason, in particular for health reasons, on the dates of reactivation of the contract holder;servation of the contract holder, provided that this administrative closure takes place during the winter season (between 01/12 and 24/04) when the ski area is open.
  • The resort of Méribel, is located in a confinement zone, during the period that corresponds to the séday, this confinement must be the subject of a ministerial and/or prefectural decision. If the station is closed during the day, the charges will be calculated on a pro rata basis for the nights consumed plus fixed cancellation charges (50€).
  • Restrictions on placement following a government decision prior to the arrival of the tenant, preventing the person who made the booking from travelling to Méribel :
    • Kilometre restriction on déplacement,
    • Confinement of the region/country of the main residence,
    • Imposed quarantine period if the Tenant returns from Méribel,
    • If the government of the Tenant's country of origin prohibits all but essential travel between the Tenant's main residence and France,
    • If travel or border restrictions in France (as decided by the relevant French administrative authorities or those of the customer’origin of the customer), making access to à Méribel, place of performance of the contract, impossible, for the person who carried out the réservation and this for the duration of the réservation.

 

The Tenant shall imperatively provide à the request for cancellation all documents that can justify the situation of confinement (ex : arrêté pré pré indicating the confinement, proof of main domicile, dé decision of his government of the’travel ban…).

As the situation may change, the cancellation of the day will only be valid on the 1st day of the rental period. The above conditions must therefore be up to date on the date of cancellation.
The Tenant may therefore cancel his booking at any time.


The amount paid will then be held until the date of its termination and returned within a maximum of 30 days, if one of the above conditions is still valid at the time of its termination.


If the reservation has been cancelled by the Hirer and on the date of its expiry the above conditions have changed (station open, end of travel ban....), the amount previously paid may be refunded, but only if the property has been re-let in the meantime, under the same price conditions.


An administration fee of 50 euros per application will be retained and deducted from the refund.


If not, and if the customer still does not wish to come, l’Agence Saulire keeps the sums due à the date of the cancellation.

 

NB : This guarantee does not apply to other reasons for cancellation, only those indicated above will be accepted under the COVID special cancellation conditions.

 

Exclusions

 

Excluded are refund requests for a reason known at the time of the reservation, in particular the closure of ski lifts and/or ski areas.

 

Consumption meter

 

Consumer mediation is provided by the National Association of Mediators (ANM CONSO).
